These Terms and Conditions apply to the mobile application FISH HACKER - Καιρός για Ψάρεμα! (the “Application”), developed by tetra-o-don (the “Service Provider”). By downloading, accessing, or using the Application, you agree to these Terms and Conditions.
If you do not agree with these Terms and Conditions, please do not use the Application.
1. Purpose of the Application
The Application provides fishing-related information, including weather forecasts, marine conditions, wave data, atmospheric pressure, solunar indicators, moon phase information, tide-related information, saved fishing spots, trophy photos, maps, and related tools.
The Application is intended for informational and recreational fishing support only.
2. No Guarantee of Fishing Success
The Application may provide fishing scores, solunar stars, best-hour estimates, tide-based suggestions, or fishing recommendations.
These indications are estimates only. The Service Provider does not guarantee that users will catch fish, that fish will be active, or that any forecast or recommendation will match real-world conditions.
Fishing success depends on many factors, including local knowledge, species, bait, technique, season, water clarity, current, human activity, safety conditions, and rapidly changing weather or sea conditions.
3. Weather, Marine, Tide, and Forecast Disclaimer
Weather forecasts, marine data, tide data, wave height, atmospheric pressure, moon data, and related information may come from third-party data providers and public APIs.
The Service Provider does not guarantee the accuracy, completeness, availability, timeliness, or reliability of this information.
The Application is not an official meteorological service, marine safety service, navigation tool, rescue service, or emergency authority.
Users must always check official weather warnings, coast guard notices, marine forecasts, local regulations, and real-world conditions before going fishing or entering coastal/marine areas.
4. User Safety Responsibility
You are solely responsible for your own safety while using the Application and while fishing.
You agree to use your own judgment and not rely exclusively on the Application for safety decisions. You should avoid dangerous areas, dangerous seas, storms, strong winds, unsafe rocks, restricted areas, and any situation that may put you or others at risk.
The Service Provider is not responsible for accidents, injuries, losses, damages, missed catches, unsafe fishing decisions, or any consequences resulting from use of the Application.
5. Emergency 112 Feature
The Application may include a 112 emergency button. This feature is provided for convenience only.
The 112 button opens the device call screen only after user confirmation. The Application does not automatically place emergency calls and is not an emergency, rescue, medical, coast guard, or safety service.
In an emergency, users are responsible for contacting the appropriate official emergency services directly.
6. Location and GPS Features
The Application may use device location or manually selected coordinates to provide local forecasts, marine data, saved fishing spots, maps, and trophy catch records.
Location-based results may be inaccurate due to GPS limitations, network conditions, map provider issues, device settings, or third-party data limitations.
You are responsible for verifying your actual location and surroundings. The Application must not be used as a navigation or safety-critical tool.
7. Camera, Trophy Photos, and User Content
The Application may allow users to take and save trophy catch photos, titles, notes, coordinates, timestamps, and weather snapshots.
You are responsible for any photos, notes, or content you create, save, or share through the Application.
You agree not to use the Application to create, store, or share illegal, harmful, offensive, infringing, or privacy-violating content.
If you share a trophy photo through another app or service, the sharing is controlled by the third-party app or service selected by you.
8. Saved Spots and Maps
The Application may allow users to save fishing spots and notes on a map. Saved spots are intended for personal use only.
Map data, satellite imagery, and map tiles may be provided by third-party services. The Service Provider does not guarantee the accuracy, availability, or completeness of map information.
Users are responsible for respecting private property, protected areas, fishing regulations, local laws, and safety rules.
9. Flashlight / Torch Feature
The Application may include a flashlight/torch feature. You are responsible for using this feature safely and appropriately.
The Service Provider is not responsible for battery drain, device heating, hardware limitations, or misuse of the flashlight feature.
10. Internet Connection and Data Charges
Certain features require an internet connection, including forecasts, marine data, tide data, maps, ads, analytics, crash reports, and API requests.
The Service Provider is not responsible if the Application does not work properly because of poor internet connection, server outages, third-party API errors, exhausted mobile data, device restrictions, or network provider issues.
Your mobile network provider may charge you for data usage. You are responsible for any such charges.
11. Third-Party Services
The Application may use third-party services that have their own terms, privacy policies, availability limits, and technical restrictions.
Third-party services may include, but are not limited to:
- Google Play Services
- Google AdMob
- Firebase Analytics, if enabled
- Firebase Crashlytics, if enabled
- Meteosource weather API
- Open-Meteo weather and marine APIs
- OpenStreetMap tile services
- Esri / ArcGIS map tile services, if satellite map view is used
The Service Provider is not responsible for the content, accuracy, availability, outages, pricing, policy changes, or actions of third-party services.
12. Advertising
The Application may display advertisements. Advertising may be provided by third-party ad networks such as Google AdMob.
The Service Provider is not responsible for third-party advertisements, advertiser content, external links, products, services, or claims made by advertisers.
13. App Cache and Stored Data
The Application may cache API responses and store some information locally on your device to improve performance, reduce repeated requests, and improve user experience.
Cached data may be outdated and should not be treated as guaranteed real-time information.
14. User Responsibilities
You agree to use the Application lawfully and responsibly. You must not:
- Use the Application for illegal activities
- Use the Application in a way that endangers yourself or others
- Attempt to reverse engineer, copy, modify, or exploit the Application
- Attempt to overload, abuse, scrape, or attack the Application or its APIs
- Use saved spots, maps, or forecasts to violate local laws or restricted areas
- Misrepresent the Application as an official weather, safety, or rescue service
15. Device Security
You are responsible for maintaining the security of your device and access to the Application.
The Service Provider strongly advises against using the Application on rooted, jailbroken, compromised, or insecure devices, as this may affect app functionality and security.
16. Intellectual Property
All intellectual property rights related to the Application, including but not limited to the name, logo, design, software code, database structure, text, graphics, and user interface, remain the property of the Service Provider or its licensors.
You may not:
- Copy the Application
- Modify any part of the Application
- Reverse engineer or extract source code
- Create derivative versions
- Use the Application’s branding without permission
17. Updates, Changes, and Availability
The Service Provider may update, modify, suspend, remove, or discontinue parts of the Application at any time.
Features may change over time. Some features may depend on third-party services, permissions, device compatibility, internet access, or future app updates.
The Service Provider does not guarantee that the Application will always be available, uninterrupted, error-free, or compatible with every device.
18. Paid Features and Future Charges
The Application may currently be provided as an ad-supported service. Certain features may be offered for free, with ads, or may become paid features in the future.
Any paid features, subscriptions, or purchases will be clearly presented to the user before payment.
19. Limitation of Liability
To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:
- Use or inability to use the Application
- Reliance on forecasts, scores, tides, maps, or recommendations
- Fishing decisions made by the user
- Accidents, injuries, losses, or unsafe conditions
- Third-party API errors, outages, or inaccurate data
- Internet, GPS, device, or network issues
- Loss of saved spots, trophy photos, notes, or local data
- Use of the 112 button or failure to contact emergency services
20. No Professional Advice
The Application does not provide professional, legal, safety, navigation, meteorological, emergency, medical, or maritime advice.
Any information shown in the Application is for general informational purposes only.
21. Termination
The Service Provider may suspend or terminate access to the Application if these Terms are violated or if the Application is discontinued.
You may stop using the Application at any time by uninstalling it from your device.
22. Privacy
Use of the Application is also governed by the Application’s Privacy Policy. Please review the Privacy Policy to understand how data and permissions are handled.
23. Changes to These Terms
These Terms and Conditions may be updated from time to time. Updates will be posted on this page with a revised effective date.
Continued use of the Application after updates means that you accept the revised Terms and Conditions.
24. Governing Law
These Terms and Conditions are governed by the applicable laws of the jurisdiction in which the Service Provider operates, unless otherwise required by mandatory consumer protection laws.
